General liability, also known as “commercial liability insurance” is a broad commercial insurance policy that covers 3rd party bodily injury or property damage exposures of a business. Pavese-McCormick recommends that all businesses have general liability coverage in place.

Professional Liability Insurance (Errors & Omissions)

Errors & Omissions (E&O) covers professionals for negligence and errors or omissions that injure their clients or cause damage to a third party’s data. This type of insurance is particularly important to licensed professionals such as accountants, attorneys, insurance agents, architects, engineers and technology companies. Pavese-McCormick recommends that all professional and technology companies have E&O coverage.

Employment Practices Liability Insurance (EPLI)

Employment Practices Liability Insurance for employers covers employment-related liabilities other than on-the-job injuries. This can include legal fees and damages for suits such as wrongful termination, discrimination, sexual harassment, and other alleged violations of employees’ legal rights. If you have employees, Pavese-McCormick recommends considering this type of coverage.

Cyber Liability Coverage

This coverage continues to evolve. Many insurance companies are developing products to provide errors and omissions and liability coverage for companies operating in cyberspace. The various forms include coverage for allegations of patent infringement, virus introduction, violation of confidentiality, loss of reputation and more. There is no standard form, standard name or consistency in coverage grants. In spite of this, if a business has an active online presence, the exposure is real and is growing such that this coverage should be considered.

Directors and Officers Insurance (D&O)

D&O covers directors and officers of a company for negligent acts or omissions and for misleading statements that result in lawsuits against the company. There is a variety of Directors and Officers coverage available such as corporate reimbursement coverage, personal liability, and entity coverage. D&O policies may be broadened to include coverage for employment practices liability as well.

Product Recall Liability Insurance

PRODUCT RECALL or PRODUCT WITHDRAWAL EXPENSE COVERAGE fills the gap caused by the General Liability product recall exclusion. This insurance covers the expenses incurred by a business when it conducts mandated and/or voluntary product recalls.

Losses from product liability suits and claims can be costly and time consuming. In addition, they can do great harm to the business’s reputation and ability to attract and retain clients. One way to reduce the likelihood of a product liability claim, or at least reduce the size of the loss if there is one, is by a product recall.

The Commercial General Liability Coverage Form excludes damages from the recall of the insured’s product or work because of a defect or dangerous condition. Product Recall Coverage helps fill this gap by providing coverage to reimburse a business for expenses following a product recall. Product Recall coverage is afforded whether initiated proactively by the insured or by a governmental agency, such as the Food and Drug Administration (FDA), Environmental Protection Agency (EPA), or the Consumer Product Safety Commission, or state governmental agencies such as departments of agriculture and departments of environmental protection.

TIME ELEMENT – Off Premise Utility Services

Most businesses depend on utilities that provide water, electricity, heat, air conditioning, and communication services to conduct their operations. Many experience a major indirect loss of income or incur substantial extra expenses to continue operations in different ways or at other locations when any of these critical utility services is interrupted. Many businesses incur extra expenses to resume operations quickly in an attempt to reduce the amount of their business income loss. They may change to an auxiliary power source or physically move to a temporary location to continue operations or provide services. Time element coverage forms do not insure these indirect (and often costly) exposures to loss when the interruption of power is due to a cause of loss that occurs off premises. However, coverage can be added.

Note: Overhead transmission lines are included only if checked as covered on the endorsement schedule. Manufacturers and distributors have the greatest need for this coverage.
